The Court of Appeal sitting in Ado has struck out the appeal filed by the Olomuooke of Omuo Oke Ekiti, Oba Valentine Adebayo Otitoju in the case between him and the Elerebi of Omuooke Ekiti, Chief Michael Akomolehin over the appointment of the Agere of Okeringun, Omuo-Oke Ekiti.
The monarch had unilaterally appointed Mr. Jamiu Dende as the Agere of Okeringun, Omuo-Oke Ekiti but his unilateral action was challenged by the Elerebi of Omuooke Ekiti, Chief Michael Akomolehin on the account that the right to appoint such chief falls within his power being the head of the Isalu clan.
The Ekiti State High Court, sitting in Omuo Ekiti and presided over by Justice Blessing Ajileye had ruled in favour of the Elerebi of Omuooke Ekiti, Chief Michael Akomolehin and sacked the chief appointed by the monarch.
Delivering the judgement of the Court of Appeal, Justice Jane Esienanwan Iyang observed that the record of appeal was not properly compiled and transmitted.
In an interview, counsel to Chief Akomolehin, Barrister Taiwo Ajayi expressed happiness over the judgement which he said had again address the assumption that monarchs have all the powers to do and undo.
