An Ekiti State High Court, sitting in Ado Ekiti has sentenced one Adedayo Olawole to death by hanging for murder.
The 29 year old convict was arraigned before Justice Jubril Aladejana on 29/03/2023 on two count charge bordering on conspiracy and murder.
The charge reads that, Adedayo Olawole (a.k.a. wolex) and others now at large at Eporo in Emure Ekiti within the jurisdiction of this Honourable Court, did conspire to murder one Chukwudi Joseph. The offences are contrary to Sections 244 and 243 of the Criminal Law of Ekiti State Nigeria, 2021.
In his testimony before the Court, one of the witnesses said, the deceased was his cousin, around 2:00 p.m., I saw the defendant and some other boys, one of them held the deceased hands at his back while others were hitting him with planks, I was shouting for help, I tried to rescue the deceased but one of the defendants gang stabbed him in the left side of his chest and fell down, they were bragging that nobody should come near them or else they will stab or kill the person.
Unfortunately, before some people came around to rescue the deceased, he had died.
The matter was thereafter reported at the Police station, he concluded.
To prove his case, the prosecutor, Ibironke Odetola called six witnesses and tendered defendant’s statements, pictures of the deceased and other supporting documents as exhibits.
The defendant spoke through his lawyer, M.A. Daramola and called one witness.
In his judgment, Justice Jubril Aladejana said in a situation where the now deceased (Chukwudi Joseph) was assaulted with planks before being stabbed in the left part of his chest, the irrestistible inference to be drawn is that the assailants intend to cause him grievous, bodily harm or his death.
He therefore satisfied that the prosecution has proved beyond reasonable doubt that the defendant and others at large conspired to commit the felony of murder at Eporo Ekiti on 10/12/2021.
Consequently, the sole issue for determination is resolved in favour of the prosecution.
On count one Conspiracy, the defendant is sentenced to seven years imprisonment without an option of fine and Count two Murder, the sentence of this court upon Adedayo Olawole a.k.a. wolex is that he should be hanged by the neck until he died.
